Course Booking Terms and Conditions
These Terms and Conditions apply to training courses, tests, assessments, qualifications and other training services provided by Entra Ltd.
By confirming a booking, making payment or attending a course, the customer agrees to these Terms and Conditions.
Where a booking is made by an employer or organisation on behalf of a candidate, the person making the booking is responsible for ensuring that the candidate receives all relevant joining instructions and course requirements.
1. Booking and Payment
An invoice will be issued following confirmation of the booking.
Unless otherwise agreed in writing, full payment is required on receipt of the invoice.
Where a booking is made within 21 days of the course or test date, payment must be made immediately.
Entra Ltd reserves the right to refuse attendance, training, testing or assessment where payment has not been received.
A provisional enquiry does not guarantee a place. A place is only secured once the booking has been confirmed by Entra Ltd.
2. Cancellations – Business Bookings
The following cancellation terms apply where the booking is made by a company, employer, sole trader or other organisation for business purposes.
All cancellations must be made in writing.
More than 21 days before the course
Where cancellation is received more than 21 days before the scheduled course or test date, any course fees paid will normally be refunded.
Any third-party costs which have already been specifically committed and which Entra Ltd cannot recover may be deducted from the refund.
Between 21 days and 48 hours before the course
Where cancellation is received within 21 days but more than 48 hours before the scheduled start time, the customer will be responsible for reasonable costs and losses arising from the cancellation.
This may include:
- Trainer costs
- CPCS tester costs
- Assessor costs
- Plant or equipment hire
- Awarding-body fees
- Registration fees
- Venue costs
- Administration costs
- Other costs specifically committed for the booking
Where Entra Ltd is unable to refill the cancelled place or recover the costs associated with the booking, up to 100% of the course or test fee may remain payable.
Less than 48 hours before the course
Cancellations received less than 48 hours before the scheduled start time, including cancellations on the day of the course or test, will normally result in 100% of the course or test fee remaining payable.
This includes a candidate cancelling shortly before the course begins.
For example, cancellation one hour before the scheduled start time would fall within this provision.
This is because trainers, testers, plant, facilities and other resources will normally have already been committed and Entra Ltd is unlikely to be able to refill the place at such short notice.
3. Non-Attendance
Failure to attend a booked course, test or assessment without providing notice will be treated as a no-show.
For business bookings, 100% of the course or test fee will remain payable.
Where additional training or testing is required following non-attendance, a new booking will need to be made and additional charges will apply.
4. Consumer Bookings
Different statutory rights may apply where an individual books training personally as a consumer rather than for business purposes.
Where applicable, consumers entering into a distance or off-premises contract may have a statutory cancellation period.
Where a consumer requests that Entra Ltd begins providing training, assessment or other services during an applicable cancellation period, Entra Ltd may require the consumer to expressly request that the service begins.
Where services have already started at the consumer’s request, the consumer may be required to pay an appropriate amount for services already supplied and losses reasonably incurred.
Cancellation charges for consumer bookings will be applied in accordance with applicable consumer law and will reflect the losses reasonably incurred by Entra Ltd.
Nothing within these Terms and Conditions affects a consumer’s statutory rights.
5. Transfers and Changes to Booking Dates
Customers wishing to transfer a booking to another date should contact Entra Ltd as early as possible.
Transfers are subject to availability and are at the discretion of Entra Ltd.
Where a transfer is requested within 21 days of the course, Entra Ltd may charge any additional or non-recoverable costs resulting from the change.
Where a transfer is requested within 48 hours of the course or test, Entra Ltd may treat the request as a late cancellation where resources have already been committed.
Repeated transfers may be treated as a cancellation.
6. Candidate Substitutions
For business bookings, another suitable candidate may be substituted where this is permitted by the relevant awarding body or card scheme.
Entra Ltd must be notified as early as possible.
The replacement candidate must meet all applicable entry requirements and provide the required identification, qualifications, cards or other documentation.
Any awarding-body or registration charges resulting from a candidate substitution will be payable by the customer.
7. Arrival and Late Attendance
Candidates must arrive at the time stated within their booking confirmation or joining instructions.
Candidates who arrive late may be refused entry where:
- A required safety briefing has been missed
- Required training has already commenced
- The delay affects other candidates
- An awarding-body requirement cannot be met
- There is insufficient time remaining to complete the training or assessment safely
- A CPCS, NPORS, NOCN or other test cannot be conducted within the allocated testing period
Where a candidate is unable to participate because they arrived late, this will normally be treated as a non-attendanceand the course or test fee will remain payable.
8. Identification
Candidates are responsible for bringing the correct identification required for their course, test or assessment.
Original photographic identification may be required, such as an acceptable:
- Passport
- Photocard driving licence
- Other identification accepted by the relevant awarding body
CPCS, NPORS, NOCN and other awarding bodies may have their own identification requirements.
Where a candidate cannot provide acceptable identification and is therefore unable to undertake their assessment or test, the booking will normally be treated as a non-attendance and additional charges may apply to rebook.
9. Course Prerequisites
It is the customer’s and candidate’s responsibility to ensure that any stated prerequisites have been met before attending.
These may include:
- CITB Health, Safety and Environment Test
- Existing CPCS, NPORS or CSCS cards
- Previous qualifications
- Relevant operating experience
- Appropriate health and safety qualifications
- Required theory preparation
- Appropriate English language ability or agreed support arrangements
Where a candidate does not meet the required prerequisites, they may be unable to undertake the course or assessment.
Any resulting rebooking costs will normally be payable by the customer.
10. Experienced and Test-Only Bookings
Experienced-worker courses and test-only bookings are intended for candidates who already have sufficient practical knowledge and experience of the relevant plant, equipment or activity.
By booking an experienced or test-only route, the customer confirms that the candidate has an appropriate level of previous experience.
Entra Ltd reserves the right to recommend additional training where a candidate’s knowledge or practical ability is below the standard reasonably expected for the booked route.
Where additional training is required, additional charges may apply.
Booking an experienced course or test-only assessment does not guarantee a pass.
11. PPE
Unless otherwise stated, candidates attending practical plant courses must bring suitable PPE.
This will normally include:
- Safety footwear
- Hard hat
- High-visibility clothing
- Suitable gloves
- Hearing protection where required
Additional PPE may be required for particular courses or activities.
Candidates who arrive without suitable PPE may be unable to participate until appropriate PPE is available.
12. Health, Safety and Candidate Conduct
Candidates must follow all reasonable instructions given by Entra Ltd trainers, testers, assessors and staff.
Candidates must comply with site rules and health and safety requirements at all times.
Entra Ltd reserves the right to stop training or assessment or remove a candidate where their conduct creates a risk to themselves, others, plant, equipment or property.
This may include:
- Unsafe operation of plant or equipment
- Repeated failure to follow safety instructions
- Aggressive, threatening or abusive behaviour
- Deliberate misuse of plant or equipment
- Attendance while under the influence of alcohol or drugs
Where a candidate is removed because of serious misconduct or unsafe behaviour, course fees will not normally be refunded.
13. Fitness to Undertake Training
Candidates must be physically and mentally capable of safely participating in the course or assessment.
Candidates should notify Entra Ltd in advance of any support or reasonable adjustment requirements relevant to the course.
Entra Ltd will make reasonable efforts to accommodate appropriate adjustments where permitted by the relevant awarding body and where this can be achieved safely.
14. Training and Assessment Results
Attendance on a course does not guarantee a successful assessment, qualification, certificate or card.
Candidates must achieve the required standard set by the relevant awarding body or card scheme.
Where a candidate is unsuccessful, additional training and/or another assessment may be required.
Further training, tests or assessments will be charged separately unless otherwise agreed.
15. Course Duration
Course durations provided by Entra Ltd are based on the expected amount of training required for candidates at the stated experience level.
Individual candidates progress at different rates.
Entra Ltd cannot guarantee that every candidate will achieve the required standard within the originally booked training period.
Where further training is recommended, additional days may be arranged and charged separately.
16. Study and Revision Material
Where Entra Ltd provides study guides, revision material or links to awarding-body resources, candidates are expected to make reasonable use of these before attending where appropriate.
Candidates undertaking CPCS or other theory assessments are responsible for preparing themselves for the relevant knowledge test.
Providing revision material does not guarantee that a candidate will pass an assessment.
17. Cancellation or Rescheduling by Entra Ltd
Entra Ltd reserves the right to cancel, postpone or rearrange a course or test where reasonably necessary.
This may include:
- Trainer illness or unavailability
- CPCS tester or assessor unavailability
- Plant or equipment breakdown
- Unsafe weather conditions
- Unsafe ground conditions
- Site closure
- Power or utility failure
- Awarding-body requirements
- Circumstances outside Entra Ltd’s reasonable control
Where Entra Ltd is unable to provide the booked service, the customer will normally be offered either:
- Transfer to another suitable available date; or
- A refund for the part of the service Entra Ltd is unable to provide.
18. Weather and Ground Conditions
Plant training and testing may be affected by severe weather or unsuitable ground conditions.
Entra Ltd will determine whether training or testing can proceed safely.
Training will not continue where Entra Ltd considers conditions unsafe for candidates, staff, plant or equipment.
Where a course needs to be rearranged due to circumstances outside Entra Ltd’s reasonable control, Entra Ltd will endeavour to offer another suitable date.
19. Plant and Equipment Breakdown
Plant and machinery are mechanical equipment and breakdowns can occasionally occur.
Where reasonably possible, Entra Ltd will:
- Provide alternative suitable equipment
- Rearrange the affected part of the course
- Extend training where appropriate; or
- Offer another suitable date
A temporary plant breakdown will not automatically entitle the customer to a full refund where Entra Ltd can reasonably provide the booked service by an alternative arrangement.
20. Travel, Accommodation and Loss of Earnings
Customers are responsible for arranging their own travel and accommodation unless specifically agreed otherwise.
Entra Ltd will not normally be responsible for indirect losses resulting from a course being cancelled or rescheduled, including:
- Travel costs
- Hotel costs
- Subsistence costs
- Loss of earnings
- Loss of production
- Other consequential business losses
Nothing within this clause excludes liability where it would be unlawful to do so.
Customers are advised to avoid making non-refundable travel or accommodation arrangements where possible.
21. Certificates, Cards and Qualifications
Cards, certificates and qualifications issued through CPCS, NPORS, NOCN or another external organisation remain subject to that organisation’s processing, verification and eligibility requirements.
Entra Ltd cannot guarantee how quickly an external awarding body or card scheme will process or issue a card or certificate.
Any timescale given by Entra Ltd is an estimate unless specifically stated otherwise.
22. Awarding-Body Rules
Courses and assessments delivered under CPCS, NPORS, NOCN or another certification scheme are subject to the current rules and requirements of the relevant organisation.
Where necessary, those requirements will take precedence over Entra Ltd’s normal training arrangements.
Changes made by an awarding body that are outside Entra Ltd’s control may affect course content, testing requirements, certification or fees.
23. Personal Information
Entra Ltd may need to share candidate information with organisations involved in the delivery, registration, assessment or certification of the booking.
This may include:
- NOCN
- CPCS
- NPORS
- CITB
- Testers
- Assessors
- Internal or external quality assurers
- Other relevant awarding or certification bodies
Personal information will be handled in accordance with applicable data protection legislation and Entra Ltd’s privacy arrangements.
24. Personal Property
Candidates are responsible for their own personal property while attending an Entra Ltd training centre or training location.
Entra Ltd will not normally accept responsibility for loss, theft or damage to personal belongings unless caused by Entra Ltd’s negligence.
25. Liability
Nothing within these Terms and Conditions limits or excludes liability where it would be unlawful to do so.
In particular, nothing excludes liability for death or personal injury caused by negligence.
Entra Ltd will not be responsible for losses resulting from circumstances outside its reasonable control.
26. Acceptance of Terms
By confirming a booking, making payment or attending the booked course, test or assessment, the customer confirms that they accept these Terms and Conditions.
Customers booking on behalf of another person are responsible for ensuring that the candidate is provided with the relevant joining instructions, course requirements and these Terms and Conditions.
Nothing within these Terms and Conditions affects any statutory rights available to consumers.
